Terms & Conditions

These terms and conditions only apply to Annata Vintage Rental Co. and Annata Vintage Rental Co. parties only. By placing a rental order, you agree to the following terms and conditions.

RESERVATIONS. Quotes and proposals do not guarantee availability. The item(s) will be reserved only upon receipt of a signed contract, 50% non-refundable retainer and a filed credit card to be used in the event of missing or damaged inventory. The remaining balance is due 14 days prior to the date of the event.

The Client's selections will arrive to the Client in good condition, cleaned and ready for use. Given the nature of the inventory, vintage items will have an expected level of wear and tear given their age. Any other damages will be recorded and stated prior to the time of booking. When the Client's rental is complete and the items are given back to Annata, it is requested that the rented inventory is returned in the same condition as how it was given to the Client, including the original packaging it arrived in.

Any glassware, plates, chargers, and serve-ware must be washed by hand only and cannot be placed into a dishwasher or any other commercial machine. Please understand that china and vintage ware is more fragile than commercial catering china and it is the Client's responsibility to inform his/her caterer/venue to insure minimal breakages. Please handle with care. In the event that an item is broken, Annata kindly asks that the Client keep the item, including all broken parts/pieces and return it with the rest of the order so that Annata can note what is missing from the order.

EVENT INSURANCE. Event insurance is not required for renting items from Annata, however, it is recommended. In the event that items are damaged, having event insurance will ensure that the Client is covered. In the event any damages exceed the Client's event insurance, the Client is responsible for those costs.

CANCELLATIONS. When the Client reserves Annata's inventory, the item(s) are immediately removed from Annata's inventory for that date. These items are committed to the Client and their event on the date stated in the contract. Therefore, any cancellations will result in a forfeit of the 50% non-refundable retainer.

If the event date changes it is subject to a new contract and a new deposit and the same items may not be available for the new date. Annata reserves the right to dismiss the contract on the spot in the event of unforeseen weather conditions or situations that potentially put the inventory at risk. In the event that this happens, the Client forfeits a refund in any amount.

FAILURE TO PERFORM. If Annata cannot perform this Agreement due to a casualty, act of God, or other cause beyond the control of the parties, or due to an unforeseen illness, then Annata shall return the retainer to the Client but shall have no further liability with respect to the Agreement.

This limitation on liability shall also apply in the event that the inventory is damaged in transit, damaged due to weather, or otherwise lost or damaged without fault on the part of Annata. This clause includes damages made by previous clients; if a rented item from the Client's order is damaged prior to their event date, Annata may substitute a similar item to be offered in its place. The Client must bear in mind that many vintage items are not easily located and an exact replica is likely not to be found, however, Annata will do everything in their power to provide the original item, by means of professional cleaning, repairs and so forth, or substitute a similar item.

In the event Annata fails to perform for any other reason, Annata shall not be liable for any amount in excess of the retail value of the Client's order.

FORCE MAJEURE. Neither Party will be liable for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes (which causes are hereinafter referred to as "Force Majeure"), to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic (including the Covid-19 pandemic), quarantine, civil commotion, breakdown of communication facilities, breakdown of web host, breakdown of internet service provider, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, or generalized lack of availability of raw materials or energy.

For the avoidance of doubt, Force Majeure shall not include (a) financial distress nor the inability of either party to make a profit or avoid a financial loss, (b) changes in market prices or conditions, or (c) a party's financial inability to perform its obligations hereunder.

In the event of any of the aforementioned causes, the Client will be given the option to move their rental to a future date, however, a full refund will not be permitted.

DAMAGED +/OR MISSING ITEMS. Once the items are picked up or delivered, the rented items become the Client's responsibility. Please understand that Annata must charge for the repair, professional cleaning or replacement of lost and/or damaged items. If professional cleaning is required and fails to bring the item to its pre-rented condition, the Client will be charged for the cleaning fee in addition to the replacement fees.

When an item is damaged or missing, not only does the item need to be fixed or replaced, but all future rentals for that item are affected as well. Many vintage pieces are hard to find and the price may vary. Weddings take up the majority of Annata's bookings, so it's important that the inventory is kept safe and in the best condition possible to ensure other clients' wedding days are exactly as they planned for.

All damaged items are subject to a charge of five times the rental value (pre-discounted) unless otherwise listed. Specific inventory will be charged a full replacement fee, which will be specified at the time of booking. Many of the settees and furniture far exceed five times the rental cost and an average cost of the item will be specified at the time of booking for those specific items.

Inventory Exceeding the 3x Rental Fee Replacement Costs are as follows:

• Couches and Settees dating prior to 1950 are $2,500 if a complete replacement is required.

• Couches and Settees dating prior to 1975 are $2,000 if a complete replacement is required.

• Couches and Settees dating after 1975 are $1,500 if a complete replacement is required.

• Poppy-wicker loveseat- is $3,500 if a complete replacement is required.

• Peacock chairs are $750 if a complete replacement is required.

Missing items may be subject to additional fees. Even if the item is severely damaged, Annata reserves the right to have the damaged inventory and all damaged parts and pieces returned to attempt to repair for future Clients. If items are not returned to Annata and are kept or thrown out, the missing items will be subject to a ten times the rental value. Given the nature of Annata, it's imperative that we have the opportunity to provide the inventory for clients who have booked those items for their future events. This excessive fee is in place to discourage keeping any of the inventory.

Rental insurance is highly recommended but not required.

The Client agrees that the following is not allowed on the upholstered furniture:

  • Drinks or liquids

  • Food

  • Smoking cigarettes/cigars, vaping pens

  • Illicit drugs including but not limited to marijuana, THC vape pens etc.

  • Pets or other animals

*The only exception to the above is for wicker or settees/upholstered furniture being used by the Client at a sweetheart table.

*In the event that a liquid or food is spilled on the item, the Client agrees to follow the steps on the care card included with their rental.

Annata Vintage Rental Co. reserves the right to substitute similar pieces in the event of unforeseen circumstances.

WEATHER + ELEMENTS. It is the Client's responsibility to have a contingency plan during inclement weather in regard to delivery and setup. If Annata's items are set up outside or are exposed to the weather/elements in any way, it is the Client's responsibility to ensure they are protected during the rental period.

Any damages due to weather will be billed to the client.

There will not be a refund or credit for any reserved items not picked up because of weather.

VENUE RESTRICTIONS. Some venues/locations may have restrictions on how and where items may be set up. It is the responsibility of the Client to check with the venue to ensure all venue guidelines are being followed.

For delivered inventory, once they are placed where specified by the Client and Annata leaves the premises, the Client and Guests are not permitted to move any large wares including upholstered couches/settees/chairs, large wicker items such as peacock and emmanuel chairs and shelves. Vintage legs are easily broken when dragged, wicker is delicate, and so on, so it is required that only Annata moves the inventory and will ensure it is where the Client wants it prior to leaving.

At the close of the event, if Annata is scheduled to pick up the items, we are only responsible for picking up our items. No other clean up is included in Annata's services.

PHOTOGRAPHY. The Client agrees to provide their event photographer's information and grant Annata permission to contact them for photos of the event. The Client's agree to provide Annata's information to their photographers and request they give Annata credit for our items if they use any images for social media/blogs/featured.

DELIVERY/PICK UP/RETURNS. All pick up and returns are by appointment only. Annata will determine the dates and times 1-2 months prior to the event. Items not returned within the scheduled time will be billed a late fee of $50.00 per 24-hour period until the item(s) are returned.

If the Client is transporting the items, all items MUST be in an enclosed vehicle or trailer at all times. Transporting in an open vehicle such as a truck, even with tarps, is NOT permitted. If necessary, items must be properly strapped down and wrapped with the provided blankets.

Any item damaged as a result of negligence due to being transported in an open vehicle or being left unsecured/unprotected in an enclosed vehicle or trailer will be charged a $100 fee in addition to the replacement fee.

OVERNIGHT STORAGE. Rentals that have a 3-day rental period are required to:

  • Be stored in a temperature controlled room or storage unit before/after the event.

  • Be indoors and fully enclosed.

  • In a secure location.

Any item damaged as a result of negligence due to being left outdoors or in a non-secure location will be charged a $100 fee in addition to the replacement fee.

ASSUMPTION OF RISK + RELEASE OF LIABILITY. The Client(s) agree to all of the above terms and are fully aware and acknowledge there may be a risk of damage or injury arising out of the use of the items rented and hereby elects to voluntarily enter into this rental agreement and assume all the risks of damage or injury.

Annata Vintage Rental Co. is not responsible for any injury or damage to persons or property arising from the goods, however caused. We do caution the Client that some of the vintage items are fragile or sharp and Annata will make sure the Client is made aware of this at the consultation and at pickup.

Annata is not liable for any transfer of color from any and all pieces of furniture that have been previously dyed at any point in time.

ITEMS SHIPPED. Any fees related to shipping inventory that is shipped is charged to the customer, including the return label sent with the package.

We will send you tracking information once your order ships so you can follow your order. To obtain delivery status or any other information regarding delivery, you must reach out to UPS directly with your tracking number. AV is not responsible for any weather delays or package mishandling by UPS.

Please drop off your rentals the next business day after your event at your local UPS. If there are any delays in returning your order please let us know immediately by emailing hello@annatavintagerentalco.com! Delays in dropping off returns at UPS will result in a 5% fee per day if your order is late.

PAYMENTS + FEES. Annata accepts payments via:

  • Annata's electronic invoice via our system using Stripe

  • Cash

  • Check (made out to Annata Vintage Rental Co.)

  • Venmo

Check or cash is preferable, however, if paying with the electronic invoice or Venmo, the Client will be billed 3.5% of the rental free to cover fees.
